Terms of service
The terms for the $99 website plan
This page covers the one-page website care plan sold by Austin Ross under the name Collister Computing.
The plan
The plan covers one page for your business. It costs $99 a month. There is no setup fee or deposit. Hosting and maintenance are included while the plan is active.
The plan runs month to month. There is no minimum term. You may cancel at any time under the rules below.
Paying the first $99 after receiving the Website Care Plan Agreement confirms that you accept that agreement and these terms.
The Website Care Plan Agreement sent to you before signup is the full agreement. If this page and that agreement conflict, the signed agreement controls.
What is included
Collister Computing builds and hosts one page with the business facts and material you approve. Maintenance includes keeping the hosted page working and making up to three requested changes to existing content per calendar month. Included changes are due within five business days under Agreement Sections 3.2.2 and 3.2.3.
A correction to Austin's own mistake does not count against the three requests.
Billing and price
The first $99 charge is due at signup. There is no trial. "$0 down" means there is no separate setup fee, build fee, or deposit before the monthly plan starts.
Stripe processes the card payment and charges the same $99 amount each month on the billing date. Collister Computing does not receive or store your full card number.
Your base price is fixed for the first 12 months from your first payment. After that, Collister Computing may change it only after giving 60 days' written notice. The change cannot be backdated. You may cancel before it starts. See Agreement Sections 6.1 and 6.1.1.
If a payment fails
Stripe retries the card and sends notices. Austin sends a personal reminder after seven days and another after 15 days. The site is not suspended before day 30, and only after at least seven days' written notice naming the suspension date.
If the payment remains unpaid, the site may be suspended rather than deleted. The agreement may end after 45 days past due, or no sooner than 15 days after a delayed suspension. Your domain is not held over an unpaid balance. See Agreement Section 6.
Changes and add-ons
A change to material already on your page is included, subject to the three-request monthly limit. Work that has to be built is an add-on.
Every add-on is quoted in writing before work starts. The quote states the one-time price and any change to the monthly bill. Work starts only after you approve that quote in writing. If you do not approve it, nothing is built or charged. This is the process in Agreement Section 3.2.1.
A monthly add-on has its own 12-month price lock. It does not change the $99 base price.
Your content, domain, and site files
You keep ownership of the words, photos, business information, and other material you provide. You confirm that you have the right to use anything you send for the site.
You own your domain. You may register it in your own account. If Collister Computing registers it for you, you are named as the registrant and it transfers to you within five business days of a request or cancellation. The transfer is free and is not held up by a billing dispute.
Collister Computing owns the reusable template and underlying code. The finished site files become yours after six monthly payments. If you cancel earlier and want those files, you may pay the balance up to six payments. That payment is optional. If you do not want the files, you owe nothing beyond the current paid month.
Your own content is returned within seven calendar days when requested, at no charge. The six-payment rule does not apply to material you supplied. See Agreement Sections 4, 5, and 8.
Collister Computing may show the finished site in its portfolio unless you opt out in writing. You may opt out later and ask for it to be removed.
Cancellation and takedown
You may cancel through the Stripe billing portal or by sending written notice to Collister Computing. The earlier notice date controls. There is no cancellation fee.
The current paid month is not refunded. The site stays online through the end of that paid period, then hosting under the plan ends and the site comes down. No later monthly charge is taken.
Collister Computing may end the agreement with 30 days' written notice. It may end sooner for the reasons listed in Agreement Section 2.3, including a payment more than 45 days late or a request for illegal work.
Idaho law also gives a separate three-business-day right to cancel the original transaction in the circumstances covered by Agreement Sections 2.4 and 9. A valid use of that right returns any payment already collected. Read the refund and cancellation policy for the short version.
Limits and Idaho law
Collister Computing does not promise a search ranking, a number of calls, or a traffic result. The work promised is the website service described in the agreement.
The agreement limits Collister Computing's total liability to the fees paid in the three months before a claim arose. It also excludes indirect or consequential losses where Idaho law allows that exclusion. It does not limit liability that Idaho law does not permit to be limited. See Agreement Sections 7 and 8.
Idaho law governs the agreement. Disputes are handled in the state or federal courts in Ada County, Idaho. See Agreement Section 10.
